Our sister blogs, IP North West and IP Yorkshire have started a campaign for at least one of the county courts in the M62 region to be designated as a Patents County Court under s.287 (1) of the Copyright, Designs and Patents Act 1988.
When the idea of a Patents County Court was first proposed 23 years ago, I argued with Henry Carr (now QC) at an LES meeting at the Manchester Club that the North needed an accessible and cost-effective local forum for the resolution of IP disputes. The slow start of the courts at Wood Green and later Regents Park under Judge Ford was the excuse for not giving us such a forum.
With the new Patents County Court Rules and the Coalition’s new initiatives for regional growth there has ever been a better opportunity to get Patents County Court designation for at least one of our county courts. It would do great things for business in the North as well as our local legal and intellectual property communities.
