Case Note: Alk-Abello Ltd v Meridian Medical Technologies

His Honour Judge Birrs QC made what may turn out to be an important decision today in Alk-Abello Ltd v Meridian Medical Technologies and Another [2010] EWPCC 14. I have written a case note on it in my IP/IT Update blog. Although the judge transferred the case to the High Court, his reasons for doing so need to be applauded:

“The decisive factor is that the court was set up to ensure that small and medium sized enterprises, and private individuals, were not deterred from innovation by the potential cost of litigation to safeguard their rights. With the new procedures in place I intend to devote my energies to making them work in order to achieve that objective.”
